Resumo: Este trabalho analisa a constitucionalidade da pesquisa com células-tronco embrionárias no Brasil, a partir do julgamento da ADI 3.510 pelo Supremo Tribunal Federal, no contexto de um Estado laico. A pesquisa parte da tensão entre a proteção constitucional do direito à vida, a dignidade da pessoa humana, o direito à saúde, a liberdade de pesquisa científica e os desafios jurídicos relativos ao embrião in vitro. Adota-se abordagem qualitativa, de natureza bibliográfica, documental e jurisprudencial, com método jurídico-dogmático e analítico, mediante exame da Constituição Federal de 1988, do Código Civil, da Lei nº 11.105/2005, do acórdão da ADI 3.510 e de obras doutrinárias e artigos científicos sobre biodireito, bioética e direito constitucional. O estudo demonstra que o ordenamento jurídico brasileiro não define de forma expressa o marco inicial da proteção constitucional da vida, o que exige interpretação sistemática e compatível com o pluralismo moral. Verifica-se, contudo, que o Supremo Tribunal Federal realizou a ponderação entre os direitos fundamentais em tensão sem antes definir o status jurídico do embrião in vitro, o que torna a fundamentação da decisão estruturalmente incompleta e explica as lacunas normativas que persistem até hoje. Conclui-se que a pesquisa com células-tronco embrionárias é constitucional quando observadas as salvaguardas legais, como a utilização de embriões inviáveis ou criopreservados, o consentimento dos genitores, o controle ético e a vedação de comercialização. Conclui-se, ainda, que a ausência de definição normativa do embrião pré-implantatório alimenta a insegurança jurídica e a vulnerabilidade do modelo de proteção gradual diante de reações legislativas regressivas, evidenciando a necessidade de marco regulatório específico capaz de acompanhar os avanços biotecnológicos sem retroceder na proteção da saúde, da ciência e da dignidade humana.
Descrição: This study analyzes the constitutionality of embryonic stem cell research in Brazil, based on the judgment of Direct Action of Unconstitutionality No. 3,510 by the Brazilian Supreme Federal Court, within the context of a secular State. The research addresses the tension between the constitutional protection of the right to life, human dignity, the right to health, freedom of scientific research and the legal challenges concerning the in vitro embryo. It adopts a qualitative, bibliographic, documentary and jurisprudential approach, using a legaldogmatic and analytical method, through the examination of the Brazilian Federal Constitution of 1988, the Civil Code, Law No. 11,105/2005, the judgment of ADI 3,510 and scholarly works and scientific articles on biolaw, bioethics and constitutional law. The study demonstrates that the Brazilian legal system does not expressly define the initial moment of constitutional protection of life, which requires a systematic interpretation compatible with moral pluralism. It is found, however, that the Supreme Federal Court conducted the balancing of competing fundamental rights without first defining the legal status of the in vitro embryo, which renders the decision structurally incomplete in its reasoning and explains the normative gaps that persist to this day. It concludes that embryonic stem cell research is constitutional when the legal safeguards are observed, such as the use of nonviable or cryopreserved embryos, parental consent, ethical oversight and the prohibition of commercialization. It further concludes that the absence of a normative definition of the pre-implantation embryo generates legal uncertainty and renders the gradual protection model vulnerable to regressive legislative reactions, underscoring the need for a specific regulatory framework capable of keeping pace with biotechnological advances without retreating from the protection of health, science and human dignity.
